The following Cases and Federal Statutes demonstrate a consistent pattern of intention by Congress to exempt State Licensed Pharmacies from Federal Government regulation. The FDA’s position overlooks the clear, identical federal statutory mandates to the contrary contained at 21 U.S.C. § 360(g)(1), § 802(15) and §374(a)(2)(A), each of which expressly exempts pharmacies from FDA jurisdiction.
